This really doesn't have anything to do with whether the picture is good or not, it is the fact that he used it without permission to do so. The photographer has rights to the image in all cases. In this case, uidzero. If wakevision didn't keep doing this with videos and now pictures, it wouldn't be a big deal.

Frye you need to calm down bro... wakevision is not doing this so please get your facts straight before you keep stating that were stealing photos and videos....It was all a misunderstanding with the pic and me and uidzero got it all straightened out. I'm trying to settle things with you to FRYE but your not responding, so at least I tried.

this is a perfect example of wakeskating going in the wrong direction. if a rider says a picture of himself can be used for something then the photographer should be stoked and allow free use of the picture at the riders discretion. the photographer may techinically own the picture but the rider is the one who truly "OWNS" the pic.

Not true at all man, taking photos is a photographers job and the picture is 100% theirs. thats cool how people are giving pics to help the growth of wakeskating but taking someones photo for monetary gain and not giving them royalties or even a photo credit is completely wrong.

Fvck man. We get it, you are pissed that he used the photo without permission, everyone backed you and ripped him apart. He took the ridicule like a man and abandoned the photo and what he was doing. Its time to get over it and look for something else to be pissed off about, jesus god in heaven.

ABSOLUTELY WRONG.

If a photographer takes a picture, it's his HIS picture. Not the rider's, and not the rider's sponsor's. And you know what? HE HAS EVERY F'IN RIGHT TO SEEK COMPENSATION FOR HIS WORK. It doesn't matter if it's used in some local rider's little clothing brand or for The Standerd.

uidzero, sorry buddy but you're no josh letchworth. not saying you can't get better, but i'd be stoked if i were you that some random website is even using that photo. get over yourself.

and everyone remember: it's wakeskating. about 75% of the population of ORLANDO doesnt even know what the hell it is.
You know what? I'm absolutely disgusted that you would say something like this. YOU@ YOU OF ALL F'IN PEOPLE! You know what? Instead of selling Esoteric you should just give it away to everyone because Scene One ain't no Justin Stephens. Go on...you've got 75% of Orlando to distribute your little video to so that you can make a name for yourself and show your fair city what wakeskating is all about. Wait...what? You want your video distributed through Sidewayz? That's weird. Rolling Eyes

But...but...you're no Justin Stephens, and nobody's ever heard of you and your video, or wakeskating at all.

Right?

I mean, isn't that the arguement that your bro is making? Give your work away because it'll help your name and it'll help you show others what wakeskating is all about. Right?

Oh, wait, no. Now it's about you, and how dare we ever tell you to give something you made away for free!

Photo, video, it's all intellectual property, and if this crap went to court uidzero would win no doubt about it.

UGGGG it doesn't matter what the photos look like or how much effort goes into videos, photographs are the property of the photographer and he was not asked permission, was not given a photo credit and did not want his photo used, BOTTOM LINE. Bang Head

<<First>>

scott a, what you're saying doesn't make sense to me. I thought that that dude thought his photo was the shizzle, and it really wasn't too amazing. i honestly did not know if he knew if it was getting-paid-for worthy. i have several photographer friends that take really amazing photos but even they have a hard time getting paid for their stuff. now i realize that he did not want that company using his photo for other, personal reasons. i take back most of what i say in that case.

okay several things:
justin stephens vs. scene one thing
riding quality : esoteric's riding quality matched completely the wakeskate parts stephens puts out (asterisk 2 and whatnot). he has a different steeze than most filmmakers: super into making it a great FILM and that vibe, which i think is cool as hell and i wish i had the funds to make stuff THAT AMAZING. but in reality, what we were trying to showcase was QUALITY WAKESKATING FROM A NEW CROWD. that to us was number one importance. the tricks. the progression. the future. so that more than makes up for the fact that stephens has a higher budget to work with: at the same time, we didn't film our video with a freakin handy-cam. we have high quality equipment and we have made videos before (local scene stuff) so we have experience in at least the production side of things (business side was a little different story). we also made sure to put extra effort into getting good shots (water housing stuff, double angles, etc.) to give it that extra professional touch. we understand the basics of filmmaking, filmed progressive riding, and had quality equipment. those things are what makes esoteric not a suitable comparison to the picture at hand, which was shot in bad light, not anything too amazing of a trick, and not really that amazing of image quality (dont get me wrong it's not a horrible picture by any means. i can't blame people who love to shoot to just do it in every condition possible anyway, and also people who cant afford to drop a load of money on a camera for something they merely consider a hobby).

also, understand the vast differences in mediums: still vs. video. still pictures have always required more precision, uniqueness, and professionalism to be used than videos, probably due to the fact that they have always captured a "moment" rather than perhaps a crazy line or something.

also, what does 75% of our beloved city mean?

and i think you may be thinking of RLAND when you talk about what you make out to sound like "orlando pride" (that i never had even been talking about - i guess keith was Rolling Eyes ) and have never EVER talked about just wanting to make our video only known in orlando (???), you're calling me a sellout (distributing stuff to sidewayz) for something i never even claimed. thanks. esoteric isn't even really THAT orlando centered: check out the credits where we list all our locations.

not sure how to end this. so bye.

As I said once before, Esoteric is how babies are made. Regardless of quality, distribution, location... it is one of the best videos (skate, wake, snow) that I've ever seen. It's just the vibe. I know for a fact that Keith and Dave put tremendous effort into this video. And to compare it to some camera phone shot being used on a new fluke website is ridiculous. It's just disturbing to even question them to me because these guys are a huge part of the industry.

There's a big difference if no one has ever heard of you and you're good than if no one has ever heard of you and you are mediocre. I know my pictures aren't the best and I've sent them in to every wake magazine there is.. and I haven't got a single shot published. If someone asked to use one I would say yes in a heart beat. I put everything I have into getting my name into the wakeskate scene. It's my passion. This guy is taking this for granted and I said it two pages ago, he should be stoked. So what's the big deal?

I don't know if it's just the Saki and beer kicking in but it just baffles me about some of the stuff that's been going on around here. Im gonna sleep it off. LATES.
