I think it depends. I certainly don't know all of the legalities on it, but a few friends of mine did get in trouble for such a project. So yes, it's totally possible to get busted!

In most states there's no law against it, there are laws stating you cannot block an entrance to a waterway so def. keep it off to the side in shallower water

if you live on a lake .... just build it one night when the sun goes down ( at least at our lake the DNR are off at night) and then hit that biotch the following days and if someone says something .... " Officer we just saw this thing in the lake and started hitting it up "

out at my place the cops where driving by my cottage and ended up calling me up and saying it was illegal to put my rail in the water, and when i asked what law i was braking they told me they would have to get back to me on that. Still to this day i have not got a call back about it. B*tch Smash ! lol

FWC was up on mine writting some sort of stuff down while tied up to it. I saw this while i was driving past it. About month and a half later its still up. Granted its not on a lake, but a major waterway none the less.

how come people pound in rails and never take them out and never get in trouble? is that because they live on private lakes?

Gnarly Dancer 42, as long as you don't start building in the middle of the lake or right near other peoples houses, the majority of lake users don't even know that your rails are there. If your going to be building permanent rails just don't act l;ike an idiot towards others on the lake (especially fishermen) and chances are noone will say anything. Everyone on our lake is super chill, all the seniors will come down to our end of the lake on weekends on their pontoon boats and just whatch us shred for like an hour...it's sick
