| We were winching at night and when the cop showed up he didn't believe that we didn't have a PWC. He got the spot light out and was searching the banks and trees around the pond like we were hidding it from him. He told us that if he ever saw us again he would arrest us. |

Because we live in a closed minded society where freedom is starting to fall victim to the veil of security, when the fact stands that winching hurts no one.
And the fact that no one in this country wants to take responsibility for their actions and sue over everything, to the point where liability means everything now _________________ √ |

i built a 40 foot rail and it is sitting outside on my lawn at my cabin. this past week i got a call from the police and they where driving by my cottage and they saw the rail and called me up and told me it was illeagal to put the rail in the water. so now i don't know what to do. The police at my lake do have a boat but they never use it i don't think it even runs so i might risk it and put the rail in the water somewhere where it is to shallow to hit it with a boat but can hit it with my winch. but i donno _________________ ~ www.integrity-wake.com ~ www.iwinchglobal.com ~ |

Seriously, this is my biggest concern when I think about buying a winch. I live in a metropolitan area, and there are various creeks & ponds all over the place, but they are all in or near parks, businesses or residential areas. Lots of them look great for winching, but I always wonder about the legal aspect.
As che blanc so eleoquently stated, liability & litigation are the name of the game these days, and it's easy to see how most property owners would have a problem with people being pulled by a strange new engine powered device on their property. I'm not even sure I would let people do it on my property if I owned some (which I don't), for fear of being sued when someone eats shizzle & their lawyer wants to cash in.
It doesn't make sense to drop the $$$ on the winch, and have no place to use it. I don't have my own private pond, nor do I know anybody who does. There may be some spots around the local lakes, but if I'm gonna drive that far, I might as well just launch the boat.
I'd be curious to know how many of you guys have had run-in's with Johnny Law or property owners while winching, and what the outcome was. Had to leave? Forbidden to return? Had the winch confiscated? Anyone arrested? Inquiring minds want to know. _________________ Life is short - live every day to its fullest. |

It definitely is a liability issue. Let's face it, someone owns just about every piece of property you can think of. If someone eats it, then they can sue for bank. I own an empty residential lot and had to notify my insurance co. after closing, because if someone is playing on it and gets hurt, guess who's held liable |

I've been winching for about a year with no problems from cops, they are 99% of the time extremely interested in what it is. If it is private property, they will usually either ask you to take it somewhere else (sometimes recommending spots) or tell you not to stay too long. If it is public property, i.e. a park, you have every right to be there. They will also usually tell you how gross that water is
They are usually very cool with you if you are cool with them. Don't be a disrespectful little shít who thinks The Man is out to get him and don't pull an attitude. Walk up to the cop with a confident smile when he pulls up and explain when he asks what the hell you're doing.

i went out once and just as i was pullin my winch rig from our trailer plot around came the po-po. hes like "thats quite the repair kit" so i explained it and he was chillin with it. of course if i was rippin up the local pond his outlook would be different but ya just dont trip when the cops come. like nick said dont use attitude cause u will just get shizzle and rightly so. as for the legality issue ive always wanted to ask if there was anything wrong with it "technically". i mean kids are in public ponds and water all the time so wuts the difference if we are just being pulled across it. most ppl i run into just have the same expression WTF. _________________ www.alliancewakeskate.com

i think as long as you have a hot girl with you, you can get away with anything. we were riding dirtibkes in the place that wasnt exactly legal and we had fourwheelers and stuff and a cop comes up and i tell my girl/friend to go talk to him because he drove up. well it just so happens that she is very attractive and happens to have large bresticles. and on top of that she was soaking with mud. cops basically were dumbfounded and said it was ok as long as we arent getting hurt. funny because weve been thrown out before without the girl there.
moral of the story kids, always have hot girls around with big milks to sweet talk the police. |

Is it a floating or fixed rail? I know if we ever tried to set up a fixed rail anywhere around my lake the MNR would come tear it down. That's why we built a floating rail...as long as it's like tied up to your dock at night it's perfectly fine. |

ZoSo, its a fixed rail. I would like to put it in the water but i might end up puting it in a winching place where boats can't hit it so it will be leagal i think. Or i could make it floating, my friend has a barge type of thing that it could go on. _________________ ~ www.integrity-wake.com ~ www.iwinchglobal.com ~ |
